Buyer
The person placing the order, identified by the e-mail address and any billing details given at checkout.
2. Subject
This agreement covers the sale and electronic delivery of the digital products listed on smurfdigital.com: diagnostic software licences, file-matching software, download credits for the ECU file archive, and time-based licences for the archive client. It also sets out the parties' rights and obligations under Turkish Law No. 6502 on Consumer Protection and the Distance Contracts Regulation.
3. Product, price and payment
- The product name, features and price are shown on the product page and repeated in the order summary before payment.
- All prices are shown in euro (EUR) and include all applicable taxes. There is no separate shipping charge — every product is delivered electronically.
- Prices are valid until updated on the site. A price change does not affect an order that has already been paid.
- Payment is taken through a licensed payment provider. Card details are entered on the provider's page and are never stored on our servers.
4. Delivery
- Delivery is electronic and immediate. Licence keys, download keys and download links appear on the order page and are sent to the e-mail address given at checkout.
- If automatic delivery does not complete, delivery is made by hand within 24 hours at the latest. The statutory maximum is 30 days from the order.
- There is no physical shipment, no carrier and no delivery address.
- If the product cannot be supplied, the Buyer is informed within 3 days and the full amount is refunded within 14 days.
5. Right of withdrawal
Under Article 15/1(ğ) of the Distance Contracts Regulation, the right of withdrawal does not apply to software, digital content and services supplied electronically and performed instantly, once performance has begun with the Buyer's consent.
By completing the order the Buyer expressly consents to immediate performance and acknowledges the loss of the right of withdrawal for that item. This does not remove the Buyer's rights where the product is faulty — see the Refund and Cancellation Policy, which is more generous than the statutory minimum.
6. Buyer's obligations
- To give accurate contact details. Keys are sent to the address entered at checkout.
- Not to share, resell or publish licence keys and download keys.
- To use the software lawfully, on vehicles and files the Buyer is entitled to work on.
7. Default and disputes
If the Buyer pays by card and the card issuer fails to remit the amount, the Seller's obligation to deliver ends. Where the Buyer is a consumer, complaints may be brought before the Consumer Arbitration Committee or Consumer Court at the Buyer's place of residence, within the monetary limits announced each year by the Ministry of Trade.
8. Force majeure
Neither party is liable for delay or non-performance caused by events outside its reasonable control, including network or payment-infrastructure outages.
9. Effect
This agreement takes effect when the Buyer approves it at checkout and completes payment. A copy is kept with the order record and is available on the order page.
